The Varnett Public School is a three-campus charter school located in Northeast and Southwest Houston, Texas. Marian Annette Cluff was the school's founding superintendent, and her husband Alsie Cluff Jr. served as the facilities and operations manager.
A federal grand jury returned a 19-count indictment against both defendants in July 2015, alleging conspiracy, mail fraud, tax evasion, and obstruction of justice. According to the indictment, the Cluffs used their positions of trust to execute two separate fraud schemes against the school.
In the first scheme, the Cluffs opened four "off-books" bank accounts in names similar to The Varnett Public School, with themselves as the only authorized signatories. These accounts were used exclusively to divert money intended for the charter school into their personal control. The accounts were deliberately named to mimic legitimate school accounts to avoid detection.
In the second scheme, Marian Cluff directed a building maintenance and landscaping contractor to submit false invoices to the school for work that was never performed. The charter school paid more than $115,000 on these fabricated invoices.
Both defendants pleaded guilty on August 25, 2017, to mail fraud and conspiracy to commit tax evasion. In June 2018, U.S. District Judge Melinda Harmon sentenced Marian Cluff to 120 months in federal prison and ordered her to pay a $295,596 fine. Alsie Cluff Jr. received a 36-month prison sentence and a $88,678 fine. Together they were ordered to pay $4,443,755.69 in total restitution.

Bank account controls would have detected the opening of four "off-books" accounts in a name similar to the school with only the superintendent as signatory — a direct red flag for self-dealing. Vendor verification requiring independent verification of invoice authenticity would have caught the false contractor invoices totaling more than $115,000. Segregation of duties preventing the superintendent from controlling both vendor selection and payment approval would have structurally blocked the false invoicing scheme. Annual audits by an independent auditor with visibility into all accounts opened in the school's name would have detected the off-books accounts early.
