Outcome: Sharon Gardner, former Director of Food Services for Hempstead UFSD, pleaded guilty to conspiracy to commit honest services wire fraud for awarding a no-bid school breakfast contract to a restaurant owner who had previously hosted her holiday parties, in exchange for kickbacks used on personal travel and home furnishings.

Sharon Gardner served as the Director of Food Services for the Hempstead Union Free School District on Long Island, New York. In her role, Gardner was responsible for running the district's competitive bidding process for food service contracts — a process she deliberately circumvented in favor of a vendor with whom she had a personal relationship.

Gardner awarded a school breakfast contract to Maria Caliendo, the owner of food service provider Smart Starts NY, Inc. and Prince Umberto's restaurant in Franklin Square. Caliendo had previously hosted Gardner's holiday parties, establishing a personal relationship that Gardner exploited to steer the contract award. Rather than following the required competitive bidding process, Gardner handed the contract directly to Caliendo's company.

In exchange for the contract, Caliendo paid Gardner kickbacks that Gardner used to fund overseas vacations and purchase home furnishings. The scheme constituted honest services wire fraud — a federal offense involving the deprivation of a public official's duty to provide honest service to their employer and the public.

Both defendants pleaded guilty in November 2022. As part of their pleas, Gardner agreed to forfeit approximately $120,000 and Caliendo agreed to forfeit approximately $160,000 in proceeds from the scheme. Each faces up to 20 years in prison. New York State Comptroller DiNapoli's office highlighted the case as part of ongoing efforts to combat corruption in school district procurement.
