Outcome: DEA issued an Order to Show Cause to Deron Kovac, D.M.D. on March 24, 2023, and revoked DEA Certificate of Registration No. FK7629340 effective August 23, 2024, because Kovac lacked authority to prescribe, administer, dispense, or otherwise handle controlled substances in the Commonwealth of Pennsylvania.
On March 24, 2023, the Drug Enforcement Administration issued an Order to Show Cause to Deron Kovac, D.M.D., a dentist registered in Pennsylvania, alleging that Kovac's DEA registration should be revoked because he was currently without authority to prescribe, administer, dispense, or otherwise handle controlled substances in Pennsylvania, the state in which he was registered.
Under the Controlled Substances Act and DEA regulations, a DEA registrant must maintain state authority to handle controlled substances in the state in which the DEA registration is issued. Loss of state-level controlled substance authority — whether through license revocation, suspension, probation, or other action by the state dental or pharmacy board — automatically renders the DEA registration invalid and subject to revocation.
DEA Administrator Anne Milgram signed the Decision and Order on July 15, 2024. The DEA revoked Kovac's Certificate of Registration No. FK7629340 and denied any pending applications to renew or modify the registration, as well as any other pending application for additional registration. The decision was published in the Federal Register on July 24, 2024.
