Evolution Health LLC is a Dallas-based home health company that operated Guardian Health Care Inc. (Texas), Gem City Home Care LLC (Ohio), and Care Connection of Cincinnati LLC (Indiana and Ohio). The settlement resolved allegations covering conduct from 2013 to 2022 — a span of nearly a decade.

The government alleged that the three subsidiary agencies provided various forms of improper remuneration to assisted living facilities and their staff and residents, as well as to certain physicians and physician groups, in exchange for referrals of Medicare beneficiaries for home health services. The kickbacks took multiple forms: lease payments to assisted living facilities (structuring facility access or space arrangements as payments rather than arm's-length contracts), wellness health services provided to facility residents at no charge, sports tickets provided to facility management and physicians, and meals. Forty-six assisted living facilities and 15 doctors and physician groups were identified as recipients of the improper benefits.

Evolution Health voluntarily disclosed the conduct to the government. In connection with the disclosure, Evolution received credit under DOJ guidelines for cooperation by identifying the individuals involved, assisting in the determination of losses to Medicare, and taking remedial action. Evolution agreed to pay $2.1 million in restitution as part of the resolution. The settlement was announced in 2024.
