The FTC filed an administrative complaint against large automotive dealer group Asbury Automotive for systematically charging consumers for costly add-on items they did not agree to or were falsely told were required. The FTC also alleges Asbury discriminated against Black and Latino consumers by targeting them with higher-priced add-ons.
The FTC alleges that three Texas Asbury dealerships (David McDavid Ford Ft. Worth, David McDavid Honda Frisco, and David McDavid Honda Irving) and general manager Ali Benli engaged in "payment packing" — convincing consumers to agree to monthly payments larger than needed to pay for the agreed price, then "packing" add-on items into the contract. The dealerships also discriminated against Black and Latino consumers, targeting them with unwanted and higher-priced add-ons. The complaint alleges violations of the FTC Act.
